WEBSITE TERMS OF USE FOR WWW.ACROSS.SK

These Website Terms of Use for www.across.sk (the “Website”) are effective as of the date of their publication. The Website Terms of Use were published on 26 February 2014.

GENERAL PROVISION

The Website Terms of Use are defined by Across Private Investments (hereinafter only referred to as “Across”) as the Website operator which has a right to unilaterally amend them from time to time. Any amendment to these Website Terms of Use becomes effective upon publication of the amended Website Terms of Use.

By your use of the Website you undertake to act in compliance with these Website Terms of Use, including any modifications and amendments hereto. The use of the Online account (Online účet) service (www.mojacross.sk) is also governed, in addition to these Website Terms of Use, by the General Terms and Conditions of the Across company.

Across has a right to amend and update the content of the information published on the Website, as well as to suspend and/or discontinue providing such information at any time without prior notice.

COPYRIGHTS

All copyrights in the Website, its design, and published images and texts are held and controlled by Across under Act No. 618/2003 Coll. on copyrights and copyright-related rights, as amended (the “Copyright Act”).

If any part of the text of the Website is used with prior expressed consent granted by Across, third parties are obliged to cite www.across.sk as the source of information.

The Across Private Investments trademark is owned by Across Finance, a.s.

LIABILITY

The Website serves solely for information and advertising purposes in relation to the products and services provided by Across. The information provided on the Website is only informative and non-binding and, with the exemption of using the OnlineAcross service, do not represent any solicitation or offer to contract. Individual products and services contained on the Website are provided and/or brokered by Across to the extent permitted by applicable permits to carry out business activities and by applicable licences for their provision.

Users connect to the Website solely at their own risk. Across is not liable for the information provided herein being accurate and up-to-date, nor for any damage caused by any use of the Website.

PERSONAL DATA PROTECTION

The use of the Website is not subject to provision of any personal data. The Website neither collects any third-party personal data. The protection of personal data when using the Môj Across (My Across) service is governed by the General Terms and Conditions of Across.

FATCA

Across fulfils all obligations in connection with compliance with tax laws, and to ensure the exchange of tax information arising mainly from the international treaty concluded between the Slovak Republic and the United States of America (hereinafter referred to as the “USA/US”), in connection with improvement of compliance with international tax laws, and by the introduction of the FATCA (Foreign Account Tax Compliance Act). Considering the adverse effects on sustainability and providing information on sustainability in the financial services sector

In November 2019, the European Union approved the Regulation (EU) 2019/2088 of the European Parliament and of the Council on sustainability-related disclosures in the financial services sector (hereinafter referred to as the “Regulation”) aimed at increasing the transparency in informing end investors (clients) on the impact of investment on sustainable development and about the risks threatening the sustainability in the financial services sector.

The aim of the Regulation is to increase the transparency in informing about how the financial market participants include the long-term sustainable development, i.e., environmental, social, and company policy criteria (Environmental, Social, and Governance, hereinafter referred to as the “ESG”) to risks and opportunities for their investment decisions.

The environmental factors include measures to fight the climate change by reducing emissions, waste management, or energy efficiency.

The social factors represent adherence to human rights, working conditions in the supply chain, prevention of illegal children’s work, and other factors such as adherence to health and safety in the workplace, integration of society with a local community, etc.

The company policy is a set of rules or principles of defining rights, obligations, and expectations between various parties involved in companies’ management. A well-defined company management system can function as a tool for successful fulfilment of its long-term strategy.

Across Private Investments, o.c.p., a.s. (hereinafter referred to as the “Company”), in accordance with this Regulation, discloses the following information:

ESG risks

The identification of the ESG risks is generally performed by the product creator (financial market participant) and the information provided by product creators can be considered in the framework of the provided investment counselling.

The Company, when selecting financial products in accordance with the Regulation, which it recommends to its clients in the investment counselling process, considers the scope of the ESG factors integration in a financial product declared by the product creator. The Company supports sustainability factors thoughtfully, but at the same time it does not rule out that among the financial instruments that it recommends to its clients in the investment counselling process, there will be also financial products in which the extent of the ESG factors integration is not published or relevant.

Considering the adverse effects on sustainability

When providing investment service, the investment counselling considers the adverse effects on the sustainability factors that are environmental, social, or occupational matters, respect for human rights, or fight against corruption and bribery by examining client preferences for investment services, considering sustainability, but it currently does not provide such investment services that would consider all the criteria for their inclusion among ESG investment services. The reason is that the Company does not have all the necessary information from third parties (financial market participants), which would allow it to consider the main adverse effects on the ESG factors and allow the end investors to make informed investment decision.

TECHNICAL PROVISION

Third parties have no right whatsoever to interfere with the Website, to modify it and/or remove or change any of its components. Across has a right to claim compensation for damage caused by the breach of this provision.

Third parties are not entitled to overload the Website with multiple simultaneous requests for access which could adversely affect its functioning (flooding). Across has a right to claim compensation for damage caused by the breach of this provision.
